Regulations

 

Within the European Union, botanicals and botanical preparations can be found in the form of foodstuffs or medicinal products. It is up to the Member States to decide which category they belong to and their health claims can only be authorised following scientific assessment by the EFSA (1), as laid out in Regulation (EC) No 1924/2006 (2).  
Today, 1,548 health claims relating to botanical substances are awaiting a decision from the Commission. However, they may be used on the EU market under the responsibility of food sector operators. 
In France, it’s the DGCCRF (3) which is responsible for assessing products subject to the principle of mutual recognition. 

 

Nutrition claims

 

"The claims assert, suggest or imply that a foodstuff has particular beneficial nutritional properties. These may be linked to its energy value or calorie content, but also to the substances it contains (4)."

 

Health claims

 

"Health claims assert, suggest or imply an existing relationship between a food category, a foodstuff or one of its constituents and health". These include:

 

  • functional claims which mention the role of a nutrient or substance in the growth, development and functions of the body. They may also refer to psychological or behavioural functions but not to a disease.
  • claims referring to a reduction in the risk of disease.
  • claims that mention the benefits of a nutrient or substance for the development and health of children. 

On the other hand, people who are ill cannot be the target population for health claims (5).

Because of these regulatory complexities, and in order to simplify your task, Natural Origins provides you with as much information as possible to support the intended claims. For example, we can offer you our CWS organic acerola extract with 17% vitamin C, which has an authorised health claim according to EFSA (see Annex to Regulation (EC) No 1924/2006): it contributes to energy metabolism, helps the immune system function properly and reduces fatigue (6).

Our acerola extract is therefore suitable for use in a wide range of formulations and can be incorporated according to our customers' needs. In particular, it is used in our ProPulse isotonic drink from our Lifestyle range.
